This came up tonight so I am trying to work it out here. This is only my opinion, very much subject to comment and change. I figure I'd better really understand my categorizations before negotiating scenes in either of these areas though!
Disclaimer Time: I do not condone the use of actual Judicial CP to punish criminals. I think starting that in a culture sets up a slippery slope to worse things. /Disclaimer
Corporal Punishment: I categorize this as any "domestic" corporal punishment technique (from any country or culture). For my purposes it generally includes American and English techniques. We are talking canes, paddles, belts, etc. administered with no warm up to get a specific pain reaction. It is supposed to be adversive. It may be physically damaging to a point (cane welts, bruises, perhaps a bit of blood). This is given in a domestic setting (or at least with a domestic mindset if one is stuck in a dungeon). Chairs, beds, or couches are used, or the miscreant is made to touch his toes, etc. These are the techniques originally designed to punish children (something else I don't condone).
Judicial Corporal Punishment: I categorize this as any *prison* corporal punishment technique. Military punishments might fit into this category as well. We are talking punishment meted out in any kind of regimented mass adult (generally male dominanted) environment where obedience is a big deal. The tools of punishment are bigger than those used in domestic scenes. The number of strokes given in a session are much smaller because each stroke *does* cause a degree of damage. Think of what it takes to get through to a miscreant child vs. what it takes to get through to an adult male criminal. The hallmark of JCP is force. In rl the force required is so great that young men are employed as the operatives--one would never see a female meting this stuff out to actual criminals. The apparatus is different too. Rather than bending someone over a chair one may strap them to a Singapore style A frame. Barring that, adapting a St. Andrew's Cross to whatever technique is being used may be convincing enough. Bondage is used (out of necessity in rl--otherwise the pain would cause people to either climb the walls or fight back).
Now that said, we are talking about a *scene*--not a prisoner from a foreign country. So one has a JCP set up and ritual, yet checks the force of the strokes to be in line with what most (even heavy) bottoms can tolerate. However, with a "pure" JCP scene I would not be concerned with the "ramp up" that I would use in a CP scene. In a CP scene I go for a certain degree of squirming right off the bat, but I do ramp up to more severe toys as endorphins start to work. In strict JCP I would rely on bondage to keep the person in place and would base the force on what they can take at the most intense part of any other scene.
With a pure JCP I would also lose the scolding. Domesticity would be out the window.
That said, in rl these categories would not be set in stone but could merge depending on the actual needs of the bottom. For instance, I may need to ramp up in what otherwise appears to be a JCP scene to meet the needs of the bottom. It may be the atmosphere the person wants more than the severity of strokes. Someone may need to be tied up and then whaled on with domestic implements without any worries about a ramp up. Etc.
